TERMS OF USE

These terms apply to everyone who uses TopRankinGames (toprankingames.com): players who vote, game owners who list games and advertisers who buy ads. By using the site, you agree to them. Please read them together with our Rules, privacy policy and cookie policy.

1. Who we are

TopRankinGames is run by Cool Monkey Studios Ltd, a company registered in England & Wales (company no. 15481762), registered office 30b Wild’s Rents, London SE1 4QG. In these terms, “we” and “us” means Cool Monkey Studios Ltd, and “you” means you, the person using the site (or the business you act for).

2. Voting

• Voting is free and doesn’t need an account.
• You can vote for each game once every 12 hours.
• Games are ranked only by player votes. Nobody can pay to move up, and sponsored spots never change a game’s position or votes.
• Each monthly race runs for a calendar month and resets at midnight (UK time) on the 1st.
• Bots, scripts, vote farms and mass voting through VPNs are not allowed. We check votes automatically and may remove any vote we believe is not genuine.
• If a game promises you an in-game reward for voting, the game is responsible for giving it. We pass the vote on to the game, but we don’t control its rewards.

3. Accounts

• You need an account to list a game or buy an ad. You must be 18 or over to create one.
• Give us accurate details and keep your email address up to date: we use it for important messages about your games, ads and account.
• Keep your password and your games’ secret keys safe. You’re responsible for what happens under your account.
• One account can list up to five games.
• If you act for a business, you confirm you’re allowed to accept these terms for it.

4. Listing your game

The full listing rules are on our Rules page. In short:

• List only games that you own or run. Names, descriptions and images must be honest, and you must have the right to use them.
• Games for adults must tick the 18+ box so they’re clearly labelled.
• Not allowed: real-money gambling, crypto or NFT games, and anything illegal or harmful. Anything else may be decided case by case.
• Private servers are welcome as long as they don’t pretend to be the official game or its publisher.
• We check every new game before it goes live. Later changes usually go live straight away, but we may review, reject or remove any listing that breaks these terms, the Rules, the law or someone else’s rights. Text with lots of links or typical spam words goes to a manual check first.
• Rewarding players for voting is fine. Forcing them to vote to keep playing, paying for votes, or offering rewards outside your game in exchange for votes is not.
• Games made by Cool Monkey Studios are marked with a “Studio game” badge. They earn their place the same way as every other listing, by player votes.

Vote links and callbacks

• If you use callbacks, we send a signed message to your server for each counted vote, with the player code your game gave us. We try up to 6 times over several hours if your server doesn’t answer or returns an error. If it rejects the message (a 4xx answer), we don’t try again.
• Player codes must be random IDs. Never use a username, email address or password as a player code.
• You’re responsible for your own game, for the rewards you give and for your players’ personal data, including telling your players about our callbacks in your own privacy policy.
• We can’t promise every callback will arrive. We’re not responsible for rewards your game doesn’t give.

5. Cheating, suspensions and bans

Buying, faking or automating votes is cheating. When we find it, we remove the false votes and:

• first offence: we send a warning;
• second offence: the owner’s account is suspended for 7 days;
• third offence: the account is banned for good.

A game that cheats can also be disqualified from that month’s race and lose its crown. For serious breaches of these terms (for example illegal content, fraud or attacks on the site), we may suspend or ban an account straight away.

While an account is suspended or banned, you can’t log in and its games are hidden. When a suspension ends, the games come back.

Appeals

If you think we’ve got it wrong, email [email protected] with your username and an explanation. We’ll look at every appeal and tell you the outcome. A suspension can be lifted or extended. A ban can be appealed once, and that decision is final. We keep a record of every appeal and its outcome.

6. Paid ads

• You can book sponsored spots from your dashboard, for one of your games or for another brand or service.
• Ads are booked in whole weeks and start at least 2 days after you book, so we have time to check them. Each block of 4 weeks is charged at the monthly price shown when you book.
• Prices are in US dollars and paid through PayPal. The price shown when you book is the price you pay. Your dates are held for a short time while you pay.
• We review every ad before it goes live. If we don’t approve it, we refund you in full.
• You can cancel a booking that hasn’t been paid at no cost. If you cancel a paid ad, it stops that day and we don’t refund the rest of the booking.
• Ads are always labelled as sponsored and open your link in a new tab. They never affect the rankings.
• You get daily totals of views and clicks for your ad. We don’t promise any number of views, clicks or players.
• If you reverse a payment (a chargeback) for an ad that has run or is running, we may stop the ad and suspend the account.

What ads can’t contain

• adult (18+) content, or ads for games labelled 18+;
• gambling;
• crypto, NFTs or tokens;
• malware, misleading downloads or links that don’t go where they say;
• hate, harassment or discrimination;
• attacks on competitors or other games;
• anything illegal, or that uses someone else’s brand, images or content without permission.

You’re responsible for your ad and the page it links to. If an approved ad, or the page it links to, later breaks these rules, we may take it down and will tell you why.

7. Verified-owner badge

• The verified-owner badge costs $10 a month, paid as a PayPal subscription that renews every month until you cancel.
• Before you subscribe, you prove you run the game’s website, either by opening a link we email to an address at your game’s domain (valid for 48 hours) or by adding a tag or file we give you to your site.
• We check again every month. If the check fails 3 days in a row, the checkmark is hidden until you verify again, and we’ll email you.
• You can cancel at any time from your dashboard or in PayPal. No more payments are taken, and the checkmark stays until the end of the month you’ve already paid for. We don’t refund part months.
• The badge shows that you’ve proved you run the game’s website. It doesn’t affect your rank or votes.

8. Winner badges, crowns and embeds

• The game with the most votes at the end of each month is crowned champion and gets a permanent plaque in the Hall of Fame. If two games tie, the one that reached the final count first wins.
• We also give badges for 2nd and 3rd place each month, for Game of the Year, for classic-era games from our 2008–2011 site, and a Founding Member badge for games approved in the first 7 days after launch.
• We may withdraw a crown or badge if we find irregular voting, and give it to the next eligible game.
• You may show your badges and our vote buttons on your own site and social channels using the code we give you. Please don’t change them, and keep the link back to your listing.
• Hall of Fame records (game name, month, place and votes) are a permanent part of our history and stay even if a game is later removed.

9. Your content and our licence

You keep ownership of everything you upload: your game’s name, logo, images, screenshots, descriptions and ads. You give us a worldwide, non-exclusive, free licence to host, copy, show, resize, crop and translate that content, and to use it on TopRankinGames, in our Hall of Fame and statistics, and in posts that promote the site and its rankings. This licence lasts while your content is on the site and for a reasonable time after, except for Hall of Fame records, which are permanent.

You confirm you have the right to give us this licence, and that your content doesn’t break the law or anyone else’s rights. If someone tells us your content infringes their rights, we may remove it.

10. Our content

The TopRankinGames name, logo, design, badges and site content belong to Cool Monkey Studios Ltd. Apart from the badges and buttons we give you to use, please don’t copy them without our permission. Linking to us is always welcome.

11. Things you must not do

• try to get around our vote limits, bot checks or security;
• scrape or copy the site in bulk, or put unreasonable load on it;
• pretend to be someone else, or another game or company;
• upload anything illegal, harmful or that infringes someone else’s rights;
• use the site to send spam or malware.

12. The service

We work hard to keep TopRankinGames running well, but we provide it “as is”. We can’t promise the site will always be available or error-free, or that your game will get a particular rank, number of votes or number of players. We may change, add or remove features. If we change the price of ads or the badge, the new price only applies to bookings or renewals made after we tell you.

13. Our liability

• Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t allow us to limit.
• We’re not liable for losses we couldn’t reasonably have foreseen, or for indirect losses.
• If you use the site for business, we’re not liable for loss of profit, revenue, business, players or goodwill.
• We’re not responsible for games, websites or ads run by others, or for rewards a game does or doesn’t give.
• Otherwise, our total liability to you is limited to the greater of £100 or the amount you paid us in the 12 months before the claim.

If you’re a consumer, nothing in these terms affects your legal rights.

14. Closing your account

You can ask us to close your account and delete your listings at any time by emailing [email protected]. Any ad or badge already paid for ends without a refund for unused time, except where the law gives you a right to one. We may close an account that breaks these terms, as described above. Some records stay after an account closes, as explained in our privacy policy.

15. Changes to these terms

We may update these terms, for example when we add features or the law changes. We’ll change the date at the top and, if a change is significant, we’ll email account holders before it takes effect. If you keep using the site after that, the new terms apply.

16. Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales can hear any dispute. If you’re a consumer living elsewhere in the UK or in the EU, you can also bring a claim in your local courts and keep the protection of your local consumer law. Please contact us first: most problems can be sorted out quickly by email.
